These terms are an agreement between you and SWISH! GM ("we", "us") and apply when you use the SWISH! GM mobile apps and the websites at swish-gm.com. By creating an account or using SWISH! GM, you agree to these terms and to our Privacy Policy. If you do not agree, please do not use SWISH! GM.1. Who can use SWISH! GMYou must be at least 13 years old, or the minimum age required to use online services in your country if that is higher, to create an account. If you are under the age of majority where you live, you must have a parent or guardian’s permission, and they agree to these terms on your behalf.
2. Your account•Give accurate information when you register and keep your email address up to date.
•Keep your password private. You are responsible for activity on your account.
•One person per account. Do not share, sell, or transfer your account, or create accounts to get around limits or bans.
•Tell us at support@swish-gm.com if you believe someone else has accessed your account.
3. The gameSWISH! GM is a basketball management simulation. All leagues, teams, players, and results are fictional. In-game money, contracts, and trades have no real-world value and cannot be exchanged for money or anything of value.We are always improving the game, so features, rules, balance, and simulation results may change. We may also reset, pause, or restore a league to an earlier point when needed to fix bugs, recover from outages, or keep things fair.
4. SWISH! GM ProSWISH! GM Pro is an optional subscription that unlocks additional features, such as creating and joining multiplayer leagues. The current features and prices are shown in the app before you buy.•Billing: Pro is sold through the Apple App Store or Google Play and is charged to your store account when you confirm the purchase.
•Auto-renewal: your subscription renews automatically at the end of each monthly or yearly period, at the then-current price, unless you cancel at least 24 hours before the period ends.
•Cancelling: manage or cancel your subscription in your App Store or Google Play account settings. When you cancel, Pro stays active until the end of the period you have paid for. Deleting the app or your SWISH! GM account does not cancel your subscription.
•Refunds: refunds are handled by Apple or Google under their policies. We cannot issue refunds for store purchases directly.
•Price changes: if the price changes, the store will notify you in advance, and you can cancel before the new price applies.
•Payment problems and lapses: if a renewal payment fails, Pro stays active for a short grace period while the store retries. If your subscription ends, you will be removed from the teams you manage in Pro leagues, and Pro leagues you commission will be paused. Paused leagues resume when you subscribe again.
5. Your content and conductYou keep ownership of what you create, such as league names, team names, profile images, and messages. You give us permission to host, display, and share that content within SWISH! GM so the game can work, for example showing your league to its members or on public league pages.When using SWISH! GM, you agree not to:•Harass, threaten, or bully other players, or post hateful, sexually explicit, violent, or illegal content, including in chat, messages, league names, team names, usernames, or images.
•Impersonate others or post someone else’s personal information.
•Spam, advertise, or scam other players.
•Cheat, exploit bugs, or use bots, scripts, or automated tools to play, scrape, or overload the service.
•Attempt to access other accounts or our systems without permission, or interfere with the service or its security.
•Copy, resell, or reverse engineer the app except where the law allows it.
6. Our intellectual propertySWISH! GM, including its software, design, logos, artwork, and simulation, belongs to us and our licensors. We grant you a personal, non-exclusive, non-transferable, revocable license to use the app for your own non-commercial enjoyment, subject to these terms. SWISH! GM is not affiliated with or endorsed by any professional basketball league, team, or player.
7. Ending your accountYou can stop using SWISH! GM and delete your account at any time in the app under Settings, or by emailing support@swish-gm.com. Deleting your account does not cancel a Pro subscription, so cancel it in your store settings first. We may suspend or end your access if you break these terms, if required by law, or if we stop offering the service. If we end your access without cause while you have an active Pro subscription, we will make reasonable efforts to arrange a prorated refund.Sections that by their nature should survive, including those on intellectual property, disclaimers, and limitation of liability, continue to apply after your account ends.
8. DisclaimersSWISH! GM is provided “as is” and “as available”. To the fullest extent allowed by law, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not promise that the service will be uninterrupted, error-free, or that game data will never be lost.
9. Limitation of liabilityTo the fullest extent allowed by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising from your use of SWISH! GM. Our total liability for any claim relating to the service is limited to the greater of the amount you paid us for SWISH! GM Pro in the 12 months before the claim, or $50.Some places do not allow these limits, so they may not fully apply to you. Nothing in these terms limits rights you have under consumer protection laws that cannot be waived.
10. App storesIf you downloaded SWISH! GM from the Apple App Store or Google Play, these terms are between you and us, not Apple or Google. Apple and Google are not responsible for the app, its content, maintenance, support, or any claims relating to it. Your use of the app must also follow the store’s own terms. For iOS users, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them.
11. Changes to these termsWe may update these terms from time to time. We will change the “Last updated” date above, and for significant changes we will notify you in the app or by email before they take effect. If you keep using SWISH! GM after changes take effect, you accept the updated terms.
